Terms and Conditions (T&Cs) for the Use of digisnoop.com
1. Scope
These Terms and Conditions (T&Cs) govern the use of the real estate acquisition tool provided by digisnoop.com. The T&Cs apply to real estate agents, real estate brokers, and referral agents (hereinafter referred to as “Customers”). By using the tool, the Customer agrees to the T&Cs in their current version.
2. Service Description
digisnoop.com provides a specialized tool for internal research of real estate properties. The content made available through the tool, including images and property descriptions, is intended solely for the Customer’s internal use and must not be publicly distributed or duplicated.
digisnoop.com does not act as a real estate agent and is not contractually or otherwise affiliated with any real estate agent, broker, or referral agent in real estate marketing. Please note that the tool may display properties that have already been sold or reserved, as a full and daily update of data cannot be guaranteed.
3. Use by the Customer
(1) The Customer is entitled to forward property listings to their clients. The responsibility for the accuracy, content, and compliance with rights to the information and images provided lies solely with the Customer.
(2) Initial contact with another agent is conducted anonymously through the digisnoop system. Contact is only released if the other agent responds to the request.
(3) digisnoop.com does not guarantee that inquiries will lead to cooperative sales or partnerships with other agents. Collaboration between the parties requires mutual agreement.
4. Contract Conclusion and Use
(1) The contract between the Customer and digisnoop.com is concluded upon registration and acceptance of the T&Cs.
(2) The use of the trial version is non-binding and grants limited access to the tool’s features. An upgrade to the paid version is possible at any time.
(3) The tool is only available to registered Customers.
5. Usage Rules
(1) The Customer agrees not to use the tool for malicious queries, excessive data retrieval, or other actions that may impair system performance or the operation of digisnoop.com.
(2) Access to digisnoop.com is limited to employees of the Customer’s own company. The sharing of usernames and passwords with third parties or unauthorized persons is strictly prohibited.
(3) The Customer is obligated to keep their access data secure and to prevent access by unauthorized third parties.
6. Contract Start and Duration
The contract term begins with the first payment and is concluded for the agreed period. Unless otherwise agreed, the contract will automatically renew for the next billing period unless terminated in due time.
7. Termination
Contract termination must be made via the admin tool in the customer area. Customers using credit card payments via Stripe or PayPal must also terminate their subscriptions directly with Stripe or via their PayPal account. The contract will continue as long as these subscriptions are not terminated. Termination is possible monthly at the end of the respective contract term, with the term starting on the date of the first payment. Termination must be made at least 14 days before the end of the current billing period. The contract will automatically renew until a termination is made. There is no entitlement to a partial refund of amounts for early termination. Payments already made will not be refunded. Upon receipt of termination, the Customer will receive a confirmation email. If no confirmation is received, the termination is considered not completed.
Note on Contract Renewal
The contract will automatically renew for an additional billing period unless terminated in due time. Renewal will be subject to the existing contractual terms.
8. Payment Terms
(1) Payment methods include credit card payments via Stripe and payments via PayPal. In both cases, the monthly fee will be debited automatically.
(2) Billing is handled by an external payment service provider, who also serves as the point of contact for payment and invoice inquiries. digisnoop.com does not assume responsibility for payments and is not the point of contact for these issues.
9. Usage Rights and Copyright
(1) The Customer receives a simple, non-transferable right to use the content provided by the tool for internal research and use.
(2) Reproduction, distribution, or public provision of the content provided by digisnoop.com, including images and texts, is prohibited.
(3) The use of images and content is at the Customer’s own risk, especially with regard to potential claims from third parties.
10. Liability and Disclaimer
(1) digisnoop.com does not guarantee the accuracy, completeness, or timeliness of the information provided through the tool.
(2) Use of the content and images by the Customer is at their own risk. digisnoop.com is not liable for damages arising from the use of the content or from claims by third parties in connection with the use.
(3) digisnoop.com assumes no liability for lost revenues, profits, or commission payments related to inquiries, cooperative sales, or partnerships with other agents.
(4) Liability for damages caused by intent or gross negligence on the part of digisnoop.com remains unaffected.
11. Support and Availability
digisnoop.com offers technical support for the use of the tool during normal business hours. There is no guarantee of continuous availability or uninterrupted operation of the tool. digisnoop.com reserves the right to perform maintenance that may temporarily restrict access.
12. Usage Restrictions
The Customer is prohibited from using the tool for automated queries through bots or other technologies that may impair system performance. digisnoop.com reserves the right to suspend or terminate access in case of misuse.
13. Sanctions for Violations
In the event of violations of these T&Cs, digisnoop.com reserves the right to suspend the Customer’s access to the tool or to terminate the contract with immediate effect. Claims for damages remain unaffected.
14. Additional Services or Modules
digisnoop.com reserves the right to offer additional services or modules, which may be subject to a fee and can be added to the existing contractual terms.
15. Data Protection
The use of the tool requires the collection and processing of personal data. Details are regulated in the privacy policy, which is an integral part of these T&Cs. digisnoop.com undertakes to comply with applicable data protection laws, including the General Data Protection Regulation (GDPR) of the European Union, where applicable.
16. Cooperation with Sales Partners
digisnoop.com works with sales partners in various countries. These partners operate independently and are not responsible for the content or the use of the tool by the Customer.
17. Changes to the T&Cs
digisnoop.com reserves the right to change these T&Cs. The Customer will be informed of any changes by email. If the Customer does not object within 2 weeks, the changes are considered accepted.
18. Right of Withdrawal
If a statutory right of withdrawal exists, the Customer will be informed of the relevant conditions as part of the contract confirmation. For digital services, the right of withdrawal may lapse once the service has been fully provided or the use of the tool has begun.
19. Leniency Arrangements
In special cases or unforeseen circumstances, digisnoop.com reserves the right to decide on leniency arrangements at its own discretion. However, there is no entitlement to leniency.
20. Applicable Law and Jurisdiction
The law of Belize applies. The place of jurisdiction for all disputes is Belize City, Belize.
